TERMS AND CONDITIONS FOR FUELQ FUEL CARD SERVICES

IMPORTANT NOTICE
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”, “your”) and FUELQ LTD trading as FuelQ (“FuelQ”, “we”, “us”, “our”). By applying for, activating, or using a FuelQ fuel card, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are entering into this agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms or use the FuelQ services.
KEY INFORMATION:
- All payments are collected via Direct Debit only – no other payment methods are accepted
- Pre-paid cards require automatic top-up when balance falls below 25% – this cannot be disabled
- 7-Day Credit Terms are only available to businesses trading for 12+ months and subject to credit approval
- Account closure requires 14 days notice and processing takes 5 working days
- INTERPRETATION AND DEFINITIONS
1.1 Interpretation
In these Terms, unless the context otherwise requires:
- words in the singular include the plural and vice versa;
- references to any statute or statutory provision include a reference to that statute or statutory provision as amended, extended or re-enacted from time to time;
- headings are for convenience only and shall not affect the interpretation of these Terms;
- any reference to “writing” or “written” includes email and notifications via the FuelQ App;
- references to “including” or “includes” mean including or includes without limitation.
1.2 Definitions
The following terms shall have the meanings set out below:
“Account” means the Customer’s FuelQ payment account maintained by us which records transactions, balance information, and account details accessible via the App and website.
“App” means the FuelQ mobile application available for download on iOS and Android devices through which Customers can manage their Account.
“Business Day” means any day which is not a Saturday, Sunday, or public holiday in England and Wales.
“Card” means the physical or digital payment card issued by FuelQ under these Terms for the purchase of fuel and related products at participating stations.
“Customer” means the individual or business entity that has entered into this agreement with FuelQ and whose application for services has been accepted.
“Direct Debit” means the payment collection method operated through GoCardless pursuant to the Direct Debit Guarantee Scheme.
“Effective Date” means the date on which these Terms come into force as stated on the cover page.
“Fuel Back” means the cashback reward scheme offering 1% back on eligible diesel purchases for pre-paid customers after the qualifying period.
“FuelQ” means FUELQ LTD, a company incorporated in England and Wales under company number 10707338, trading as FuelQ, whose registered office is at 4th Floor Silverstream House, 45 Fitzroy Street, London W1T 6EB.
“Partner” means any third-party organisation with whom FuelQ has entered into commercial arrangements for the provision of additional benefits or services.
“PIN” means the Personal Identification Number associated with a Card for security purposes.
“Platinum Card” means FuelQ’s premium fuel card product offering with both pre-paid and credit term payment options.
“Station Network” means the network of over 4,300 UK fuel stations that have agreements in place to accept FuelQ Cards for payment.
- AGREEMENT AND ACCOUNT FORMATION
2.1 Formation of Contract
The contract between you and FuelQ shall be formed when we accept your application for a FuelQ Card. We reserve the absolute right to accept or reject any application in our sole discretion and without providing reasons. Your application constitutes an offer to enter into a contract with us, which we may accept or decline. No contract exists between us until we have confirmed acceptance of your application in writing.
2.2 Eligibility Criteria
To be eligible for a FuelQ Account, you must:
- be at least 18 years of age;
- have a valid UK bank account capable of supporting Direct Debit payments;
- provide true, accurate, current and complete information during the application process;
- if applying as a business, be properly incorporated or registered and have authority to enter into this agreement;
- for Credit Terms, have been trading for a minimum of 12 months and meet our credit criteria.
2.3 Verification and Credit Checks
As part of our application assessment process, we may:
- conduct identity verification checks using the information you provide;
- for Credit Terms applications, perform credit checks through Experian or other credit reference agencies;
- request additional documentation to verify your identity or business status;
- use automated decision-making and credit scoring systems;
- share information with credit reference agencies which may be recorded on your credit file.
You acknowledge and consent to these checks being performed. Credit searches may temporarily impact your credit score. We may decline applications based on the results of these checks without obligation to disclose our reasons.
- PAYMENT TERMS AND OPTIONS
3.1 General Payment Obligations
You agree to pay all amounts due under these Terms in accordance with the payment option selected during your application. All payments must be made via Direct Debit through our payment processor GoCardless. We do not accept any other form of payment including but not limited to credit cards, debit cards, bank transfers, cash, or cheques. Failure to maintain an active Direct Debit mandate will result in immediate suspension of your Account.
3.2 Pre-paid Option
If you select the pre-paid option:
- Your Account will be pre-loaded with an amount equivalent to two weeks of estimated fuel spend based on the information provided in your application;
- When your balance falls below 25% of the initial load amount, an automatic top-up will be triggered via Direct Debit to restore your balance to the full two week amount;
- The automatic top-up feature is mandatory and cannot be disabled or opted out of;
- You must ensure sufficient funds are available in your bank account to cover automatic top-ups;
- No credit check is required for pre-paid accounts;
- Pre-paid accounts are eligible for our Fuel Back rewards program after the qualifying period.
3.3 7-Day Credit Terms (Business Only)
Credit Terms are available exclusively to business customers and are subject to the following conditions:
- Your business must have been actively trading for a minimum of 12 months;
- You must pass our credit assessment conducted through Experian;
- Your business must not have any County Court Judgments (CCJs) or Individual Voluntary Arrangements (IVAs) within the past 6 years;
- Weekly Direct Debit collections will be taken every Monday for the previous week’s fuel usage;
- A valid Direct Debit mandate must be maintained at all times;
- Credit Terms may be withdrawn at our discretion with 30 days’ notice.
- CARD USAGE RIGHTS AND RESTRICTIONS
4.1 Permitted Use
The Card is provided solely for the purchase of fuel and approved fuel related products at participating stations within our Station Network. The Card remains the property of FuelQ at all times and must be returned or destroyed upon request. You are granted a non-exclusive, non transferable license to use the Card in accordance with these Terms. Any use outside these parameters constitutes a breach of contract and may result in immediate termination.
4.2 Security Obligations
You are responsible for maintaining The security of your Card and PIN at all times. You must:
- keep your Card secure and not allow any unauthorised person to use it;
- memorise your PIN and never write it down or share it with anyone;
- immediately report any loss, theft, or unauthorised use to us;
- not use the Card for any illegal or fraudulent purpose;
- comply with all applicable laws and regulations when using the Card.
4.3 Prohibited Activities
The following activities are strictly prohibited and will result in immediate Account termination:
- reselling fuel purchased with the Card;
- using the Card at non participating stations;
- purchasing non-fuel items unless specifically authorised;
- allowing third parties to use your Card;
- any fraudulent or deceptive activity;
- any use that violates these Terms or applicable law.
- PRICING AND FEES
5.1 Fuel Pricing Structure
Our fuel pricing operates on a tiered structure designed to provide competitive rates across our network. Diesel prices are calculated as follows: (a) Core FuelQ price represents our standard discounted rate; (b) Supermarket sites are priced at pump price plus 4.8 pence per litre; (c) Band A-E stations apply a surcharge of up to 5 pence per litre above the core price depending on location and operating costs. Prices are subject to change and current rates are displayed in the App. We endeavour to provide accurate pricing information, however, actual pump prices may vary and you should always verify the price at the point of sale.
5.2 Fuel Back Rewards Programme
Pre-paid customers are eligible to participate in our Fuel Back rewards programme subject to the following terms: You will earn 1% cashback on the net value (excluding VAT) of all eligible diesel purchases. The qualifying period is 30 weeks from the date of first card use. Your first Fuel Back payment will be available for redemption after completing 30 weeks of active card usage. Subsequent Fuel Back will be credited after each invoice is paid. Rewards are credited directly to your FuelQ card balance and cannot be withdrawn as cash. If you close your Account before completing the 30 week qualifying period, any accrued but unpaid Fuel Back will be forfeited. We reserve the right to modify, suspend, or terminate the Fuel Back programme at any time with reasonable notice.
5.3 Fee Schedule
The following fees apply to your Account:
No Charge Services: Account setup, account closure, initial card issuance, expired card replacement, first replacement card, and standard customer support.
Chargeable Services: Subsequent replacement cards (£5 per card), failed Direct Debit (£10 per occurrence), late payment fee for Credit Terms (£15 after 7 days), non-diesel product transactions (variable percentage shown on invoice).
All fees are exclusive of VAT where applicable and will be automatically debited from your Account or collected via Direct Debit. We reserve the right to modify our fee structure with 60 days’ written notice.
- LOST, STOLEN AND FRAUDULENT USE
6.1 Reporting Obligations
You must notify us immediately upon becoming aware that your Card has been lost, stolen, or subjected to unauthorised use. Notification must be made through one of the following channels: (a) FuelQ App via the Report Lost/Stolen function; (b) Customer service telephone on 0800 140 4641 during office hours; (c) WhatsApp message to our designated number; (d) Email to [email protected]. Time is of the essence in reporting, and any delay may affect your liability for unauthorised transactions and our ability to prevent further misuse.
6.2 Liability for Unauthorised Transactions
Your liability for unauthorised transactions depends on the circumstances and your compliance with these Terms. You will not be held liable for fraudulent transactions that occur after you have properly notified us of the loss, theft, or unauthorised use, provided such notification is made within 24 hours of discovery. You may be held fully liable for all losses if: (a) you have acted fraudulently; (b) you have intentionally or with gross negligence failed to comply with your security obligations; (c) you have shared your PIN or Card with another person; (d) you have failed to notify us promptly upon discovering the loss or unauthorised use. We maintain comprehensive fraud monitoring systems, but ultimate responsibility for Card security rests with you.
- DATA PROTECTION AND PRIVACY
7.1 Data Processing
We process your personal data in accordance with applicable data protection legislation including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By entering into this agreement, you acknowledge that we will collect, use, and share your personal data as described in our Privacy Policy and these Terms. We act as the data controller for all personal data collected through your use of our services. Our lawful bases for processing include contract performance, legal obligations, legitimate interests, and where applicable, your consent.
7.2 Data Sharing
We may share your data with: (a) credit reference agencies for credit checking and fraud prevention; (b) our payment processor GoCardless for Direct Debit collection; (c) Partner organisations for the provision of additional benefits, subject to your consent; (d) law enforcement and regulatory authorities where required by law; (e) our service providers who assist in delivering our services. All data sharing is conducted in compliance with data protection laws and subject to appropriate safeguards. You have the right to object to certain types of data processing and sharing as set out in our Privacy Policy.
- TERMINATION AND SUSPENSION
8.1 Termination by Customer
You may terminate this agreement by providing us with 14 days’ written notice. Notice must be given during office hours (8:30am to 5:30pm, Monday to Friday) via email to [email protected] or by calling 0800 140 4641. Upon receipt of your termination notice: (a) we will process your request within 5 Business Days; (b) you must settle all outstanding balances; (c) any remaining pre-paid balance will be refunded within 30 days; (d) balances under £5 may be retained to cover administrative costs; (e) unpaid Fuel Back earned before completing 30 weeks will be forfeited; (f) you must destroy your Card immediately; (g) if you wish to reopen an account in future, you must submit a new application.
8.2 Termination and Suspension by FuelQ
We may suspend or terminate your Account immediately and without notice if: (a) you breach any provision of these Terms; (b) we suspect fraudulent or unauthorised activity; (c) you fail to make any payment when due; (d) you provide false or misleading information; (e) we are required to do so by law or regulation; (f) you become insolvent or enter into any form of insolvency proceedings. We may also terminate this agreement for any reason by providing 30 days’ written notice. Upon termination, all outstanding amounts become immediately due and payable.
- LIABILITY AND INDEMNIFICATION
9.1 Limitation of Liability
To the fullest extent permitted by law, our total aggregate liability to you under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount of the transaction(s) in dispute. We shall not be liable for: (a) any indirect, consequential, special, incidental, or punitive damages; (b) any loss of profits, business, contracts, revenue, or anticipated savings; (c) any loss of data or information; (d) any loss arising from events beyond our reasonable control. Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded or limited under applicable law.
9.2 Indemnification
You agree to indemnify, defend, and hold harmless FuelQ, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; (c) your unauthorised or fraudulent use of the Card; (d) any claim by a third party arising from your use of our services; (e) your negligence or wilful misconduct. This indemnification obligation will survive the termination of these Terms.
- GENERAL PROVISIONS
10.1 Entire Agreement
These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and FuelQ relating to the subject matter herein and supersede all prior or contemporaneous agreements, negotiations, representations, and proposals, written or oral, relating to such subject matter.
10.2 Variation
We reserve the right to modify these Terms at any time. Material changes will be notified to you with at least 60 days’ notice via the App and email. Non material changes may be made with immediate effect. Your continued use of the Card after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to any modifications, you must terminate your Account before the changes take effect.
10.3 Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision as closely as possible.
10.4 Waiver
No failure or delay by either party in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any other or further exercise thereof. Any waiver must be in writing and signed by the party granting the waiver.
10.5 Assignment
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any third party without your consent, provided that such assignment does not materially prejudice your rights under these Terms.
10.6 Third Party Rights
These Terms are for the benefit of you and us, and are not intended to benefit or be enforceable by any third party. The exercise of the parties’ rights under these Terms is not subject to the consent of any third party.
10.7 Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, save that we may bring proceedings against you in any other court of competent jurisdiction.
10.8 Dispute Resolution
Before commencing any legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiations. If you have a complaint, please contact our customer service team who will attempt to resolve the matter. If we cannot resolve your complaint satisfactorily, you may be entitled to refer the matter to the Financial Ombudsman Service or other relevant dispute resolution scheme. This does not affect your statutory rights to commence court proceedings.

ACCEPTANCE OF TERMS
By applying for, activating, or using a FuelQ Card, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you are accepting on behalf of a company or other legal entity, you represent and warrant that you have full authority to bind that entity to these Terms.
